Reservation Fee Policy

The full Commission payable to Broker shall be payable at the time Owner and renter sign a Rental Contract between them, or at the time the renter takes possession of the Vehicle, whether or not a Rental Contract is executed. Owner agrees that a reservation fee of 25% of the estimated total rental (which includes the total of the daily rental rate times the number of days of the rental and mileage charge) shall be collected by Broker from renter as agent of Owner, and shall be held by Broker and applied to Broker's Commission. The amount of any reservation fee which is in excess of the Commission payable by Owner to Broker shall be paid by Broker to Owner within a reasonable time period after Broker's receipt thereof. In the event Owner collects a reservation fee from a renter, such reservation fee (up to the amount of the Commission) shall be immediately forwarded by Owner to Broker. In the event any additional rent (above the rent initially agreed upon between Owner and renter) is collected by Owner, Owner shall immediately pay 25% of such additional rent to Broker as its Commission on such excess.

In the event a renter cancels a Rental Contract 30 or more days before the rental date, Broker shall return 50% of the reservation fee received by Broker to renter and retain the remaining portion of the reservation fee as Broker's Commission. In the event Owner received the reservation fee attributable to such cancelled Rental Contract, Owner will immediately remit 50% of the reservation fee to renter and 50% to Broker. In the event the renter cancels a Rental Contract within 30 days of the rental date, Broker shall retain 50% of the reservation fee and pay the balance to Owner, and renter will forfeit the entire reservation fee. In the event Owner received the reservation fee attributable to such cancelled Rental Contract, Owner will immediately remit 50% of the reservation fee to Broker.

In the event Owner is not able to comply with the Rental Contract due to servicing or mechanical break down only, Broker will attempt to locate another vehicle to accommodate the renter. If no other vehicle, acceptable to renter, is available, Broker agrees to take no Commission, and will return 100% of the reservation fee to the renter, and Owner will agree to the cancellation of the Rental Agreement.
